Terms of service

Welcome to the Talpress Domains registration service (hereinafter: the "Service" or the "Company"), operated by the TalPress web agency. 

This agreement constitutes a legally binding contract between you (hereinafter: the "Client" or the "User") and TalPress. By purchasing a domain or using the Service, you declare that you have read, understood, and agreed to all the terms detailed below.

1. Nature of Service and Third-Party Providers

1.1. Talpress acts as an authorized Reseller of the OpenSRS domain registrar, accredited by ICANN.
1.2. As part of the Service, we provide a platform for registering new domains, renewing existing domains, transferring domains to or from us, and DNS record management services for supported extensions.
1.3. Domain registration is additionally subject to the Terms of Service and name allocation policies of ICANN and the main Registry of each specific extension.

2. Domain Registration, Renewal, and Management

2.1. Accurate Information: When registering a domain, the Client is obligated to provide correct, accurate, and complete contact details (WHOIS information). Providing incorrect or false details may lead to the suspension or cancellation of the domain without prior notice and without a refund.
2.2. Domain Renewal: It is the Client's sole responsibility to track the domain's expiration date and ensure timely renewal. Talpress will send automated email reminders before the expiration date, but bears no responsibility for domain loss due to non-renewal for any reason (including failure to receive the reminder or payment method failure).
2.3. Grace Period: If a domain is not renewed on time, it may enter a Grace Period and/or a Redemption Period, which vary by extension. Releasing a domain from the Redemption Period involves significantly higher fees determined by the global Registry, which will be borne by the Client.

3. Prices, Payments, and Taxes

3.1. Currency and VAT: All prices displayed on the site are in New Israeli Shekels (NIS / ₪) and include a Value Added Tax (VAT) of 18%, as required by law.
3.2. Payment Processing: Payments are processed and secured by the Pelecard clearing company. Credit card details are not stored on Talpress servers.
3.3. Rate Changes: Registration, renewal, and transfer prices may change from time to time according to global Registry pricing and exchange rate fluctuations. The determining price for renewal is the price displayed in the shopping cart at the actual time of payment, not the initial registration price.
3.4. Payment Failure: In the event a payment is returned, canceled by the credit card company (Chargeback), or dishonored for any reason, Talpress reserves the right to suspend the domain, lock it, or cancel the registration until the full debt is settled, including handling fees.

4. Refund and Cancellation Policy

4.1. No Right to Refund: Due to the immediate nature of the domain registration service (which are registered in real-time with global databases), no refunds will be granted for domain registration, renewal, or transfer fees once the request has been successfully submitted to and executed by the registrar. This applies even if the Client changes their mind, misspells the domain name, or does not use it.
4.2. Refund for Technical Failure: A full refund will be issued automatically solely in cases where the domain registration or renewal process failed technically and was not actually completed in the registrar's systems.

5. Acceptable Use, Restrictions, and Enforcement

5.1. Lawful Use Only: The Service is intended for lawful purposes only. It is strictly forbidden to use domains registered through us for fraud (Phishing), malware distribution, unsolicited email (Spam), copyright infringement, trademark violation, or any activity that violates the laws of the State of Israel or ICANN policies.
5.2. Right of Suspension: Talpress reserves the full right (but not the obligation) to lock, suspend, or cancel a domain registration without a refund if substantiated complaints of Abuse are received, or if any section of these terms is violated.

6. Limitation of Liability

6.1. "As-Is" Basis: The Service is provided on an "As-Is" and "As-Available" basis. Talpress does not guarantee a service free of faults, disruptions, or downtime, and shall not be liable for indirect damages, loss of income, or loss of data resulting from the use or unavailability of the Service.
6.2. Liability Cap: The total and maximum liability of Talpress towards the Client for any claim, damage, or out-of-pocket loss (whether in contract or in tort) shall be limited to the cumulative amount paid by the Client to Talpress for the specific service during the 12 months preceding the date the cause of action arose.

7. Use of Artificial Intelligence (AI) Agents

7.1. Nature of the Service and Absence of Immunity from Errors The user declares, understands, and agrees that the artificial intelligence agents (hereinafter: "AI Agents" or "Language Models") operated within the system are based on evolving technology, and as such, they may produce incorrect, incomplete, or inaccurate outputs, recommendations, or responses. It is the user's sole and full responsibility to examine, verify, and validate that any change or configuration proposed by the AI Agent is correct and fully corresponds to their request and needs prior to their actual implementation.

7.2. Limitation of Liability It is hereby clarified that TalPress Domains shall bear no liability, whether direct or indirect, for any damage, downtime, technical malfunction, or loss of income caused as a result of incorrect configurations or actions performed in reliance upon information, responses, or recommendations provided by the AI Agent.

7.3. Execution of Changes in an Active Domain and Double Confirmation Mechanism Notwithstanding the foregoing, in instances where the AI Agent proposes to execute technical or operational changes in an active domain, the system will require the user's approval to perform the action at least twice (Double Confirmation) prior to applying the change. It is clarified that from the moment the user has granted their approval for the execution of the action by the AI, the full responsibility for conducting post-change integrity checks and for all associated consequences rests solely with the user.

7.4. Information Sharing and Third-Party Privacy The user understands and confirms that any information, input, text, or data entered by them or shared during the interaction with the AI Agents is transferred for processing to the language model providers (a third party). The use of this information is exclusively subject to the privacy policies of those providers. TalPress Domains does not control the information transferred to the language models and shall bear no liability regarding the manner of its processing, retention, or use by these third parties.

7.5. Additional Information Regarding Language Models Details and information regarding the specific language models currently used by the system, including links to their privacy policies, are available for user review under the site's Privacy Policy page.

7.6. Service Availability (Uptime) and Reliance on Third Parties The AI Agent services are provided to the user "As-Is". The system relies, inter alia, on Application Programming Interfaces (APIs) and technological infrastructures of external providers. TalPress Domains does not guarantee continuous and full availability of the AI Agents and shall bear no liability for any damage, loss, or detriment caused as a result of delays, slow response times, crashes, or temporary or permanent unavailability of the service, including instances where such unavailability delays the execution of technical actions in domains or DNS records.

7.7. Fair Use and Prevention of Abuse The use of the AI Agent system is subject to the rules of fair and reasonable use. It is strictly prohibited to make any attempt at reverse engineering the language models, to bypass or alter the agent's instructions ("Prompt Injection"), to attempt to breach the system's security mechanisms, or to send an excessive and unreasonable volume of requests that may overload the system's infrastructures. TalPress Domains reserves the exclusive right to limit the rate of requests (Rate Limit), to suspend, or to completely block the user's access to the AI services, without prior notice, in any case where abnormal, excessive, or malicious use is identified.

7.8. Absence of Professional and Legal Advice It is hereby clarified that the information, responses, and recommendations provided by the AI Agent are intended solely for the purposes of technical and operational assistance within the system. No information produced by the agent constitutes, nor should it be viewed as, a substitute for legal, business, financial, or other professional advice. The agent's responses must not be relied upon in legal matters of any kind, including issues of copyrights, trademarks, domain ownership, or legal disputes. The responsibility for verifying the legal and statutory status of domains rests solely with the user.

7.9. Permissions and Authorized Actions Any action executed by the AI Agent at the user's request – including but not limited to: altering DNS records, updating Name Servers, changing registration details, or modifying domain configurations – shall be deemed an action executed directly by the user. The agent's actions are carried out in accordance with the permission level of the user logged into the account at that time. The user shall bear full and exclusive responsibility for any action executed at their request by the agent in the system, as if they had executed it manually themselves.

7.10. Identity Verification and Security of Means of Contact For the purpose of maintaining information security and prior to the execution of changes by the AI Agent, the system will require the user to verify their identity by entering the email address or telephone number linked to their account. The user declares and undertakes that it is their sole and full responsibility to secure their means of contact (including the email inbox and mobile phone device) and to protect them from any unauthorized access. TalPress Domains shall bear no liability for any damage, configuration change, loss of information, or undesirable action caused as a result of verification performed by a third party who gained unauthorized access to the user's email inbox or telephone device.

8. Governing Law and Jurisdiction

8.1. The laws of the State of Israel shall exclusively govern these terms and any dispute or claim arising from the use of the Service.
8.2. Exclusive jurisdiction over any matter relating to these terms or the use of the Service is hereby granted to the competent courts in the Tel Aviv-Yafo district.
